    An Important List to Keep

    March 31, 2009

I know, I know, I usually give legal advice.  Today's post is going to be advice of a more practical nature... (Ok, well it's kinda legal, but I can't help myself.  Sad, really.  It's a curse.)

I have a story to tell, with an important lesson to be learned and I thought that I'd share it with you because it's so simple, but SO important.

How many of you keep a list of everyone who has your address?  Did you register your company with the state using your address?  What about your trademark?  Did you register using your address?  The list goes on and on...

    Here's why you should...

I was contacted by a client the other day who had received a direct message on Twitter asking her to give up her Twitter name because the person writing to her (We'll call her Jane) claimed to hold the trademark on that name.

So, I went and looked it up in the USPTO (United States Patent and Trademark Office) database.  Turns out that Jane had actually lost her trademark in January to a challenge from another mark holder.

Why did she lose?  Because Jane never responded to the action.  And why, you might ask, did she never respond?  Because Jane moved several years ago and never corrected her address with the USPTO.

I had my client have her contact me.  Jane was shocked when I explained to her what had happened.  She had spent lots of time and money building her brand and getting her trademark.  Now it's going to take more time and money to get it back.

So, I'm going to ask YOU...

Are you in danger of making the same mistake?

It only takes a few minutes to make the list and keep it up, but it's an important list to have.
